Common questions
Economic damages, explained
What are economic damages in a personal injury case?
Economic damages are the financial losses an injury causes that can be measured in dollars: past and future lost earnings, lost earning capacity, the value of household services the injured person can no longer perform, and the cost of future medical care, often set out in a life care plan. Non-economic damages, such as pain and suffering, are left to the jury and are not part of an economic damages analysis.
What does a forensic economist do as an economic damages expert?
A forensic economist calculates those losses, reduces future amounts to present value, documents every assumption and source in a written report, and explains the analysis at deposition or trial. In Texas, lost earnings and earning capacity are presented net of federal income tax under Tex. Civ. Prac. & Rem. Code § 18.091.
